Advertisers and members of the public responding to advertisements on our Internet sites

Using of or continued use or proceeding the placing of advertisements on any Lets holiday site signifies your acceptance of these terms and conditions.

LETS HOLIDAY MAKES NO REPRESENTATION OF ANY KIND REGARDING THE SUITABILITY OF THE SITE CONTENT, OR ANY PORTION THEREOF, FOR ANY PURPOSE. ALL SITE CONTENT IS PROVIDED "AS IS" AND TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, LETS HOLIDAY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PARTICULAR USE, INCLUDING ALL IMPLIED WARRANTIES. LETS HOLIDAY ALSO EXPRESSLY DISCLAIMS ANY WARRANTY OR REPRESENTATION AS TO THE ACCURACY OR PROPRIETARY CHARACTER OF THE SITE CONTENT. NOTHING IN THIS AGREEMENT SHALL EXCLUDE OR LIMIT LETS HOLIDAY'S LIABILITY FOR (I) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE; (II) FRAUD; OR (III) WILFUL DEFAULT OR GROSS NEGLIGENCE (IV) ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED UNDER APPLICABLE LAW. SUBJECT TO THE FOREGOING, YOU USE THE SITE AT YOUR OWN RISK AND NEITHER LETS HOLIDAY NOR THE PARTIES WHO PROVIDE INFORMATION AND MATERIAL FOR PUBLICATION WITHIN THE SITE CONTENT SHALL BE LIABLE FOR ANY LOSS OR DAMAGE OF ANY SORT ARISING FROM YOUR USE OF THE SITE AND/OR SITE CONTENT INCLUDING WITHOUT LIMITATION, ANY DIRECT, INDIRECT, PUNITIVE OR CONSEQUENTIAL LOSS OR DAMAGES, OR ANY LOSS OF INCOME, PROFITS, GOODWILL, DATA, CONTRACTS, USE OF MONEY, OR LOSS OR DAMAGES ARISING FROM OR CONNECTED IN ANY WAY TO BUSINESS INTERRUPTION OF ANY TYPE, AND WHETHER IN TORT (INCLUDING WITHOUT LIMITATION NEGLIGENCE), CONTRACT OR OTHERWISE) IN CONNECTION WITH THE SERVICE OR THIS SITE IN ANY WAY OR IN CONNECTION WITH THE USE, INABILITY TO USE OR THE RESULTS OF USE OF THIS SITE. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL OR INTENTIONAL DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Lets holiday does not accept responsibility for any advertisements of an illegal, immoral, defamatory or offensive nature placed on the website. All advertisements placed on the website are the sole responsibility of the advertiser and no liability shall attach to Lets holiday in any circumstances whatsoever in this regard. In the event that an advertisement of an illegal, immoral, defamatory or offensive nature is placed on the website, Lets holiday should be immediately notified whereupon it will Endeavour to remove the offending advertisement with all possible speed.

A. Members of the public

1. USE OF WEB SITE
Use of any Lets holiday member web sites (hereinafter called “the Site” or collectively 'the Sites') is subject to these terms and conditions. If you do not agree to these conditions after reading them please stop using the Site immediately. These terms are a legal agreement between Lets holiday, the advertiser and or member of the public and can only be modified with our consent. We reserve the right to change the terms and conditions at our discretion by changing them on the Site.

2. ACCURACY OF INFORMATION
Lets holiday reproduces photos of properties and details relating to them on our sites that are supplied to us by the owners of the properties or their agents. We rely on the owners or their agents to update or correct information on these sites which we publish in good faith. If you believe any information on the Site to be inaccurate, please advise us immediately and we will investigate and correct if necessary as soon as possible. However, it is your responsibility to make relevant enquiries with the owners or their agents before renting any of the properties advertised.
Lets holiday accepts no liability and offer no warranties in relation to it and its content to the fullest extent that such liability can be excluded by law.

3. COPYRIGHT
These sites contains copyright material, trade names and other proprietary information, including, but not limited to, text, software, photos, graphics. The entire contents of the sites are protected by copyright law, the Data Protection Acts 1988 and 2003 (as amended) or the database right. Lets holiday own the copyright and/or database right in the selection, co-ordination, arrangement and enhancement of the content of theses sites.
You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part except as provided in these Terms.
You may download information from the Site for your own personal use only. You acknowledge that you do not acquire any ownership rights by downloading copyright material.

4. OUR LIABILITY
Lets holiday provides the information on all web sites free of any access charge. The information provided on these sites is provided on the basis of Lets holiday Ltd, its subsidiaries, affiliates, partners and networked sites having no liability for the information given.
In no event shall we be liable to you for any direct or indirect or consequential loss, loss of profit, revenue or goodwill arising from your use of these sites or information on these sites.
Any opinions, advice, statements, services, offers, or other information or content expressed on these site are those of the owners of the properties or their agents and not the responsibility of Lets holiday.
We do not endorse or recommend any of the properties on our Site. The information does not constitute any form of advice or recommendation by us and is not intended to be relied upon by you in making (or refraining from making) any decision to rent a property.

5. LETTING OF PROPERTIES
Any contract for the letting of any of the properties on these sites or any other product or service advertised on the site is between you and the owner or agent of the property.
If you make an arrangement with any of the owners or their agents, this is at your sole risk.

6. LEGAL JURISDICTION AND DISPUTE RESOLUTION
Irish law shall apply to these terms, notwithstanding the jurisdiction where you are based. You irrevocably agree that the courts of Ireland shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms and for those purposes irrevocably submit all disputes to the jurisdiction of the Irish courts. The place of performance shall be Ireland.

B. Advertisers

1. CONTENT OF ADVERTISEMENTS
Lets holiday accepts advertisements in good faith and expects that advertisers will provide an accurate description of their property.

2. All advertisements should comply with relevant Irish legislation including the Consumer Information Act, 1978 (which covers false or misleading descriptions). The advertiser agrees to indemnify Lets holiday against all claims costs arising out of any misleading information in the advertisement.

3. Lets holiday will take every care to reproduce faithfully the text, prices, contact details and photographs provided to us by advertisers. We will not however be held liable for any loss arising out of any error or omission on our part.

4. Lets holiday reserves the right to determine the design and layout of advertisements, and (at our discretion) make alterations to submitted text or photographs, should we consider any to be necessary. Lets holiday will not be held liable for any loss arising out of such alterations.

5. MATERIALS AND PHOTOGRAPHS
Lets holiday will take the utmost care of all materials and photographs provided for the preparation of advertisements, but cannot be held liable for any loss or damage however caused.

6. COPYRIGHT
It is the responsibility of the advertiser to ensure they have the right to reproduce any photographs or digital images which they supply to us. The advertiser agrees to indemnify Lets holiday against all claims costs arising out of any infringement of copyright for such photographs or images.

7. All digital images produced by Lets holiday from photographs supplied by advertisers are the property of Lets holiday, and shall not be reproduced without our permission.

8. LIABILITY
Lets holiday cannot be held liable for any loss or damages howsoever incurred, including consequential losses such as lost income, in connection with advertising on any Lets holiday web site.

9. STANDARDS OF ACCOMMODATION
The owner or their agent shall ensure that the accommodation advertised is clean and in a fully habitable and acceptable condition.

10. EXCHANGING PROPERTIES
Each advertisement relates to a particular property which is given a unique reference number. It is not allowable to substitute a different property by changing the text and photographs on an advertisement.

11. MAINTAINING ACCURATE AVAILABILITY
Lets holiday expects all advertisers to update their availability the moment it changes or at least once a week, even if there has been no change. Advertisers are expected to maintain the professionalism of Lets holiday by ensuring that holidaymakers do not waste their time with unnecessary emails and telephone calls about properties that are already booked for the weeks in question.

12. Under no circumstances should an advertiser refer a member of the public to another property owner not advertised with Lets holiday nor offer alternative accommodation not advertised by Lets holiday.

13. REFUSAL, TERMINATION OR WITHDRAWAL OF ADVERTISING
Lets holiday reserves the absolute right to refuse to accept any advertisement submitted. If the advertisement has been paid for on-line a full refund will be made, or if a cheque has been received by post this will be returned. Any materials submitted by post will not be returned unless a stamped and addressed envelope has been provided. Under no circumstances will any compensation be payable by Lets holiday for any loss howsoever incurred, including loss of income, the time/cost involved in submitting the advertisement etc.

14. If Lets holiday receives a complaint about a property, we reserve the right to remove that property from our web site without notice, if in our opinion, the complaint is reasonably substantiated. Such complaints could relate to the accuracy of an advertisement, the condition or maintenance of the property, unacceptable booking conditions or procedures, lack of adequate response to complaints etc. In all cases our decision will be final. A refund may be made pro-rata for the remaining unused period of the advertisement, however under no circumstances will any compensation be payable by Lets holiday for any loss howsoever incurred, including loss of income, re-advertising costs etc.

15. On receipt of an application, Lets holiday will endeavour to process the details within 24 hours of receipt. The advertisement will appear on the Lets holiday website within 24 hours of receipt of payment. The INSERT LENGTH OF ADVERTISING PERIOD advertising period will commence from the date the advertisement goes live.

16. Completion of the application form by the advertiser will be deemed to be the advertisers acceptance of our terms and conditions. The processing of the application form by Lets holiday will be deemed to be our acceptance of the advertisement. Payment by the advertiser will be required notwithstanding once Lets holiday have processed the application.

17. The advertiser may choose to withdraw their advertisement from the Lets holiday web site at any time - please notify us in writing (letter or e-mail). They may also request that that their advertisement is reinstated at any time during the period of advertising purchased. Please note that the period of advertising will not be extended to allow for the time when the advertisement was not showing on the web site. No refund will be made for any advertisement that is withdrawn by an advertiser.

18. LEVEL OF SERVICE
Lets holiday will make every effort to provide advertisers with a first class service. We will endeavour to approve new advertisements, and approve changes to existing advertisements as quickly as we possibly can. However, as we have no control over the number of requests that we receive at any time, we are unable to guarantee response times.

19. Lets holiday will endeavour as far as practical to ensure that the web sites are available on the internet at all times. However some breaks in service are inevitable and often beyond our control, we are therefore unable to guarantee 100% up time.

20. Lets holiday guarantee to include all advertisement on all new pertinent web sites as and when new sites join the Lets holiday Group. This will be done for the advertising period and at no additional charge.

21. Lets holiday also guarantee to provide other alternative advertising sources to all Lets holiday advertisers through all Lets holiday search engines, networks and search directories at no additional charge.
